After the arrest, the owner of property must put in a request to the NYPD Property Clerk for the items. A demand for the property must be made within 120 days of the termination of criminal proceedings/ when the property was vouchered.

  • A lawyer may do this as an "authorized representative." Otherwise, the owner of property must appear in person at the property clerk office of the respective borough where the property was taken.

  • Need to bring a copy of the property voucher, the invoice number, proper identification, and the District Attorney's release (unless the property was not arrest evidence, in which case a DA release is not required). The individual has 270 days to get a release form from the DA. After that deadline, the NYPD can “dispose” of the property. You can get DA release forms at the DA office in the appropriate borough.
