Only the Supreme Court in New York can grant a divorce (not Family Court). You should go to the Supreme Court in the county where you or your spouse currently lives.

There are different kinds of divorces
- Uncontested divorces (easier)
When both spouses want to get a divorce, and agree over what will happen with children, property, and finances.
The Court provides free forms for this kind of divorce (see link above).
Contested divorce
When either spouse does not want to get a divorce, disagree about the reasons (grounds) for the divorce, or disagree about what will happen with children, finances, or property.
These cases usually go before a judge many times and require legal representation.
